Réunie ce mardi 28 juillet 2026 sous la présidence de Mahamadou Mansour Mbaye, la Haute Cour de justice a ordonné le renvoi du procès de l’ancien ministre de la Justice, Ismaïla Madior Fall, à l’issue de la pause judiciaire. La juridiction a par ailleurs accédé à l’une des requêtes phares de la défense en ordonnant la mainlevée du bracelet électronique de l’ancien Garde des Sceaux.
L’audience, qui s’est ouverte aux alentours de 10 h 20 en présence du président de la cour et de huit députés-juges, a été très vite interrompue par des batailles de procédure soulevées dès l’entame des débats. Avant même la lecture de l’ordonnance de mise en accusation – pour des charges incluant association de malfaiteurs, corruption, tentative d’extorsion de fonds, concussion et prise illégale d’intérêts -, les nouveaux conseils de l’ancien ministre ont sollicité un report d’audience pour kes motifs principaux :
-Manque d’accès aux pièces : Mes El Hadj Diouf et Ibrahima Mbengue, nouvellement constitués aux côtés de l’équipe de défense, ont plaidé l’impossibilité de garantir les droits de la défense sans avoir préalablement pris connaissance de l’intégralité du dossier.
-Connexité et mesures coercitives : Me Ciré Clédor Ly a appuyé la demande en rappelant qu’une instruction liée à cette affaire (concernant l’entrepreneur Cheikh Guèye) demeure pendante devant une autre juridiction, tout en réclamant le retrait du bracelet électronique de son client.
Face à ces arguments, le Procureur général près la Haute Cour, Jean-Louis Paul Toupane, a souligné que le dossier était « en état » tout en s’en rapportant à la sagesse de la juridiction sur l’opportunité du renvoi.
À la reprise de l’audience après délibération, la Haute Cour de justice a tranché en faveur des requêtes formulées par les conseils de l’accusé en renvoyant le jugement après les vacances judiciaires et en le libérant de son dispositif de surveillance électronique.
